Welcome to Colorus.io! These Terms of Service ("Terms") govern your use of our website and services (collectively, the "Service"), operated by Tremtastic Labs LLC ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Description of Service

Colorus.io provides a service that transforms user-uploaded digital photographs into digital and/or physical coloring books. The service includes file storage, image processing via third-party APIs, and coordination with third-party print-on-demand and shipping providers.

2. User-Generated Content

You are solely responsible for the photos and any other content you upload to the Service ("User Content").

• Ownership: You retain all ownership rights to your User Content. We do not claim any ownership of your photos.
• License Grant to Us: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify (e.g., convert to a coloring page), and distribute your User Content for the sole purpose of providing and fulfilling the Service you have requested. This license terminates when you delete your User Content or your account.
• Your Responsibility: You represent and warrant that you own your User Content or have the necessary rights and permissions to grant us the license described above, and that your content does not infringe upon the intellectual property, privacy, or other rights of any third party.

3. Use of Third-Party Services

To provide our Service, we rely on trusted third-party partners for essential functions. By using Colorus.io, you acknowledge and agree that we may share your User Content and order information as necessary with these partners to fulfill your request. These functions include, but are not limited to:

• Secure Cloud Storage: Storing your uploaded photos on secure cloud infrastructure.
• Image Processing: Sending your photos to a specialized service to perform the technical image-to-coloring-page transformation.
• Printing and Shipping: Providing the final coloring book files and shipping information to a print-on-demand vendor for manufacturing and fulfillment of physical orders.

4. Prohibited Content and Conduct

You agree not to upload any content that is illegal, defamatory, obscene, infringing on copyright, or hateful. You also agree not to interfere with the Service's security or abuse the Service in any way. We reserve the right to remove any content and terminate accounts that violate these terms.

5. Purchases and Refunds

All sales of custom-made printed coloring books are final. Due to the personalized nature of the product, we cannot offer refunds or accept returns unless the product has a manufacturing defect or was damaged during shipping. If you receive a defective or damaged product, please contact us within 14 days of receipt with photographic evidence.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service. In no event shall our aggregate liability exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us, if any, in the past six months for the services giving rise to the claim.

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
